Attorney Kathryn Clarke of Portland, OR; ethical gremlin

 
The state of Oregon provided Kathryn H. Clarke with a law license in 1979.
 
The Oregon State Bar found Kathryn guilty of the following misconduct
  1. Misconduct involved selfish motives
  2. Failed to maintain proper client trust account records
  3. Failed to inform clients about status of legal matter
  4. Failed to respond to repeated communications from client
  5. Failed to withdraw from representation when it was mandatory to so act
  6. Intentionally failed to carry out contract of employment
  7. Failed to provide competent representation (moron)
  8. Misconduct involved multiple offenses
  9. Misconduct caused actual harm to client
  10. Failed to provide appropriate accountings to client
In one matter, Kathryn represented George Livesley in an appeal of an adverse decision by the Employment Relations Board (ERB). Subsequently, Kathryn filed a timely notice of appeal on behalf of Livesley.
 
During an eight month period of time, Kathryn filed motions for extension of time to file the opening brief in Liveley’s appeal. Subsequently, Kathryn decided that Livesley didn’t have a basis to appeal and did not file the required brief on his behalf. Kathryn failed to disclose her decision to Livesley and did not withdraw from representing him. Kathryn knew her decision was material to Livesley when she failed to disclose it.
 
Shortly thereafter, the Court of Appeals dismissed Livesley’s appeal. Kathryn failed to disclose the dismissal of the appeal to Livesley or take any action on his behalf. After Livesley discovered the dismissal, Kathryn failed to withdraw as his attorney. Without obtaining Livesley’s consent, which she confirmed in writing, Kathryn agreed to reevaluate the merits of the appeal at a time when her potential liability for legal malpractice resulting from her gross negligence had affected and reasonably would continue to affect her judgment on his behalf.
 
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Oregon Supreme Court punished Kathryn by gifting her with a complimentary 60-day suspension of her law license. 
 
As we speak (ca. January 2013) Kathryn continues to practice in the Portland, Oregon area.
