Attorney John Faraone of Wilmington, DE; lying loser

 
The state of Delaware presented John A. Faraone with a law license in 1974. Also licensed to practice in New Jersey.
 
The Delaware Supreme court found John guilty of the following misconduct.
  1. Assisted a conduct in fraudulent conduct
  2. Knowingly made a false statement of material face
  3. Engaged in conduct involving dishonesty, fraud, deceit or misrepresentation
  4. Engaged in a continuing course of misrepresenting (lying) to sellers in real estate transaction
  5. Failed to advise sellers of real estate to seek independent counsel
  6. Failed to correct misstatements of face when he had a duty to so act
In one matter, John represented a client in two similar real estate transactions. Both transactions were structured as mortgage assumptions. However, both left the sellers responsible to their lenders for additional mortgage payments after the conveyance of the property to the client’s assignee. John knowingly misled the sellers into believing that their mortgage lender would not hold them responsible following the conveyance of their property. John also failed to advise them to consult with independent counsel when they asked him whether they would be protected. When the client filed to make the mortgage payments, the lender threatened the sellers with foreclosure.
 
In another matter, John found it acceptable to provide assistance to his client in a scheme to defraud the State and County of real estate taxes. The scheme involved John’s materially false representation to the sellers in a real estate transaction that they would be relieved of liability on their mortgage.
 
As a consequence of his misconduct, apologists for Attorney Misfits sitting on the Delaware Supreme Court punished John by gifting him with a complimentary 180-day suspension of his law license.
 
As we speak (ca. December 2012) John practices at 1213 King Street in Wilmington, Delaware.
