Attorney Charles Giles of Tucson; repeat offender

 
The state of Arizona presented Charles M. Giles with a law license in 1964 after he graduated from the University of Arizona Law School.
 
The Arizona State Bar found Lee guilty of engaging in misconduct on two occasions as set forth below.
 
Charles’ 1st bite at the Attorney Misfit Apple Tree
 
Charles represented two separate collection agencies. In the first matter, a lawsuit was filed to collect a debt of approximately $2,000 owed to a client. The court granted Charles’ request for a prejudgment provisional remedy conditioned upon the posting of the applicable garnishment bond. The bond was posted and the client thereafter paid annual garnishment bond fees; however, instead of posting the bond, Joseph entered into an agreement with the defendant whereby the defendant paid the amount being claimed by the client in lieu of the court –ordered garnishment.
 
Charles then placed the money into the collection agency’s trust account pending resolution of the lawsuit, but failed to inform the client of the agreement. Consequently, the client unnecessarily continued to pay the annual bond premium for a period of at least five (5) years.
 
Charles failed to respond to the clients numerous requested regarding the status of the lawsuit and the need to continue paying the annual bond premium. Through its own investigation, the client learned several years later that the bond was never posted by Charles.
 
In the second matter, Charles filed a lawsuit to collect a debt of $54,000 owed to his client. The trial court set a trial date and advised counsel that failure to timely file a joint pretrial statement would result in dismissal without prejudice of the lawsuit. Charles failed to file the pretrial statement and the trial court dismissed his client’s case. Despite repeated inquires from his client, Charles failed to tell the client about the dismissal. The client only learned of the dismissal after employing another attorney.
 
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Charles by gifting him with a complimentary 60-day suspension of his law license.
 
Charles’ 2nd bite at the Attorney Misfit Apple Tree
 
  1. Failed to withdraw as attorney of record when required to do act
  2. Failed to promptly deliver client funds owed to client
  3. Failed to provide complete accounting of his client trust accounts
  4. Engaged in a pattern of misconduct
  5. Misconduct involved multiple offenses
Charles’ misconduct again involved his actions as a collection attorney. When the client’s management changed, Charles failed to timely cease work on some of the collections against the instructions of his client. In truth, Charles told his client: “Up Yours!”
 
As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Arizona Supreme Court punished Charles by gifting him with a complimentary 120-day suspension of his law license.
 
As we speak (ca. December 2012) Charles practices at 2720 East Broadway Blvd in Tucson, Arizona.
