Attorney Harvey Goldstein of Milwaukee; serial thief

The state of Wisconsin presented Harvey J. Goldstein with a law license in 1977 after he graduated from Marquette University Law School.

The Office of Lawyer Registration (OLR) found Harvey guilty of 21 counts of misconduct relating to three estates and a process server’s ethics complaint, which is as follows.
  1. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  2. Commingled client funds with personal funds
  3. Misappropriated (stole) client funds
  4. Failed to keep required records of trust account deposits
  5. Failed to file overdraft notification agreement with the OLR
  6. Allowed creditors to make electronic withdrawals from trust accounts
Over the course of several years, Harvey failed to pay $19,000 for process services provided to him. Harvey lied to the OLR that he couldn’t pay because his client had failed to pay him. Subsequently, the OLR discovered that Harvey had received and deposited more than $29,000 to his trust account from the client he falsely claimed hadn’t paid him.

During its investigation of the process server matter, the OLR discovered that Harvey had converted (stole) more than $69,000 from three separate estates and used those funds to pay for personal and business expenses, including an Arizona real estate venture. I

In regards to the first estate, Harvey failed to deposit $39,400 of fiduciary funds in a separate account and he later made a cash withdrawal from that estate’s checking account to pay personal expenses.

Harvey also failed to file an overdraft notification agreement with the OLR regarding the checking account of one of the estates and failing to identify that account on his State Bar dues statement, and by falsely certifying that he did in fact have an overdraft agreement on file for his trust and fiduciary accounts.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Wisconsin Supreme
Court punished Harvey by gifting him with a complimentary 2-year suspension of his law license.

As we speak (ca. May 2013) Harvey’s law office is located at 309 North Water Street in Milwaukee, Wisconsin.
