Attorney John Hershberger of Germantown, TN; ethical misfit

 
The state of Tennessee provided John Robert Hershberger with a law license in 2001 after he graduated from the University of Memphis Law School.
 
The Tennessee Board of Professional Responsibility found John guilty of the following misconduct.
 
While representing himself in a legal matter, John presented the trial court with a Petition for Scire Facias and a Citation for Contempt (FIAT). John asked the trial court to sign the FIAT and schedule a hearing on the matter.
 
The trial judge refused to sign the FIAT due to the fact that John was represented in the matter by an attorney. John then submitted the FIAT matter to another judge; however, John didn’t tell the judge that the presiding judge on his case had previously refused to sign the FIAT.
 
The Board ruled that John’s conduct violated his sworn duty to be truthful when dealing with a tribunal.
 
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Tennessee Supreme Court punished John by gifting him with a complimentary censure.
 
As we speak (ca. November 2012) John practices at 2950 Oaksedge in Germantown, Tennessee.
