Attorney Erika Frank of Windham, ME; ethical misfit
The state of Maine presented Erika L. Frank with a law license in 1996 after she graduated from the University of Maine Law School.
The Maine Grievance Commission found Erika guilty of the following misconduct.
As one would suspect, this wasn’t Erika’s 1st bite at the Attorney Misfit Apple Tree. She previously received a complimentary reprimand for engaging in conduct prejudicial to the administration of justice . Prior to this complimentary reprimand, Erika received a complimentary warning for violations concerning client communications.
Erika’s misconduct involved the 2011 real estate closing concerning property located in Gray, Maine. Erica represented the buyers and also served as the closing agent. She was therefore responsible to make all disbursements after closing. For a variety of reasons, Erica failed to timely disburse said funds.
Among the disbursements Erica was required to make was the payoff of the seller’s outstanding mortgage. However, Erica’s negligence led to a mistake on the wire transfer sheet. As a result, interest on the balance accrued resulting in a higher payoff amount. After she subsequently paid off the mortgage, Erika’s trust account no longer had sufficient funds to pay the real estate taxes and the neighborhood association fees.
As a consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the grievance panel punished Erika by gifting her with yet another complimentary reprimand.
As we speak (December 2012) Erika practices with the Law Office of Erika L. Frank at 936 Roosevelt Trail in Windham, Maine.
