Attorney Mary Greely of Boston; ethical misfit

The state of Massachusetts presented Mary Laura Tanner Greely with a law license in 1989.

The Massachusetts Board of Bar Overseers found Mary guilty of the following misconduct.

As we speak (ca. November 2012) Mary practices with Brown Rudnick LLP at One Financial Center in Boston, Massachusetts.

An aunt of Mary’s had all of her estate planning needs, including a series of wills and a pour-over trust first executed in 1999 and amended in 2002, prepared by an estate-planning lawyer. The last will nominated Mary and the estate-planning lawyer as co-executors.

Subsequently, the aunt asked Mary to prepare documents to nominate her as the sole executor of her estate in order to save administrative costs. Mary prepared a codicil to the aunt’s will that removed the estate-planning lawyer as co-executor and left Mary as the sole executor of the will.

Massachusetts law mandated that two persons act as witnesses when the aunt executed the will and that a notary be present. When the aunt signed the will there was only one witness, the notary and Mary. Mary and the notary then returned to Mary’s office. Mary than had another secretary falsely sign the will as a witness.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Board of Bar Overseers punished Mary by gifting her with a complimentary reprimand.
