Attorney Russell Zarkou of Mesa, AZ; ethically deprived

 
The state of Arizona presented Russell J. Zarkou with a law license in 1980 after he graduated from Arizona State University Law School.
 
The Arizona State Bar found Russell guilty of engaging in the following misconduct
  1. Bad faith obstruction of disciplinary rules
  2. Refused to acknowledge wrongful nature of his conduct
  3. Failed to deposit client funds in client trust account
  4. Refused to provide trust account records to Bar investigator (Up Yours, said Russell!)
Russell represented the Pecan Grove Village III Homeowner’s Association. The Board of Directors noted that a certain property was in arrears and asked Russell about placing a lien on the property and/or garnishing the owner’s wages. Russell then received a request from the property manager to file a foreclosure action. After he filed the foreclosure action, Russell sent the Association a bill in the amount of $1,098.80 for his fees, which the Association paid the same day.
 
The property owner then met with Russell and paid him $1867.30 that represented Russell’s fees paid by the Association and the arrearages on his Association fees. It took Russell five (5) months before he paid the Association the $768.50 the property owner paid for arrearages.

As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Kenneth by gifting him with a complimentary 30-day suspension of his law license.
 
As we speak (ca. November 2012) Russell continues to practice in the Mesa, Arizona area.
