Attorney James Glynn, Jr. of Andover, MA; ethical leprechaun

The state of Massachusetts presented James A. Glynn, Jr. with a law license in 1964.

The Massachusetts Board of Bar Overseers found Leonard guilty of the following misconduct.

When James’ widowed client died, she was survived by nephews, nieces and cousins. She had no children. She died owning assets totaling less than $120,000. James had known the client since his childhood because the client and his mother were close friends. James frequently socialized with the client and considered her to be his aunt, but he wasn’t related to her by blood.

For several years, James performed legal and non-legal services for the client. James represented the client when she sold her home, which netted her $59,760. Subsequently, James prepared and had the client execute an irrevocable trust. James named himself as trustee and the client as sole beneficiary while she was alive. Upon the client’s death, the undistributed income remaining in trust was to be distributed to James if he survived the client, and if not, to James’ children. When the trust was created, James funded the trust with $19,775 from the proceeds from the sale of the client’s home.

Over a three month period of time, James drafted and had the client sign a series of authorizations that permitted him to withdraw a total of $19,600 form the client’s trust account. James used the funds to run his law office.

The Board of Overseers ruled that James was engaged in an egregious conflict of interest in regards to setting up the client’s trust so that it would financially benefit him and/or his children.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Board of Bar Overseers punished Leonard by gifting him with a complimentary 181-day suspension of his law license.

As we speak (ca. October 2012) James practices with the Law Offices of James A. Glynn, Jr. at 14 Essex Street in Andover, Massachusetts.
