Attorney Gayle Ghitelman of Boston; repeat offender, liar

The state of Massachusetts presented Gayle S. Ghitelman with a law license in 1982.

The Massachusetts Board of Bar Overseers found Gayle guilty of misconduct on at least two separate occasions, some of which is as follows.

Gayle’s 1st bite at the Attorney Misfit Apple Tree
  1. Failed to cooperate with Bar Counsel investigators (Up Yours, said Gayle!)
  2. Failed to timely return client file to client’s new attorney after she was fired
  3. Neglected a legal matter entrusted to her
  4. Failed to adequately communicate with client
In one matter, Gayle represented a worker in an alien labor certification process. After filing the initial application, the INS requested further evidence and gave Gayle 12 weeks to respond. However, Gayle failed to respond which led to the INS sending a notice of abandonment of the application with a notice of appeal rights, with a 30 day limitation period. Gayle ignored the notice and took no further action on the client’s behalf.

Gayle failed to respond to numerous calls from her client and the client’s employer regarding the status of the alien labor application. Gayle was fired and the employer demanded a refund of the $2,110 advance fee it had paid. Gayle refused to refund the advance fee until after the employer filed an ethics complaint against her.

As one would expect, Gayle previously received a complimentary admonition for engaging in similar misconduct.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Board of Bar Overseers punished Gayle by gifting her with a complimentary reprimand.

Gayle’s 2nd bite at the Attorney Misfit Apple Tree

Gayle was employed to assist a client in pursuing permanent residency status through a labor certification. About two years later the client fired Gayle and retained another attorney to pursue permanent residency status on his behalf.

The client’s new attorney faxed a request to Gayle for return of the client’s file. Gayle responded by sending what she claimed was a copy of the client’s application for Alien Employment Certification filed with the U.S. Dept. of Labor. In addition, Gayle enclosed what purported to be a copy of the Final Determination of the client’s Application for Employment Certification with Gayle’s certification that the copy was a true and accurate copy of the original. Gayle explained in her letter to the new attorney that she certified the copy of the Final Determination because the original appeared to have been misfiled by her.

The copies of the Application and the Final Determination that Gayle sent to new counsel were fabricated by her. Gayle never filed any application on behalf of the client and the government never issued a Final Determination.

Gayle’s Hyperbolic (BS) Defense

Gayle had the audacity to claim in mitigation that during the time she fabricated the documents and lied about them that she was suffering from clinical depression. This BS claim doesn’t pass the involuntary laugh tests! As one would expect, the comedians sitting on the Board of Bar Overseers bought into Gayle’s BS in crediting her with mitigation for her serious misconduct.

As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Board of Bar Overseers punished Gayle by gifting her with a complimentary reprimand.

As we speak (ca. October 2012) Gayle practices with the Law Office of Gayle S. Ghitelman at 6 Beacon Street in Boston, Massachusetts.
