Attorney John Gianino of Weymouth, MA; cheater
The state of Massachusetts presented John Anthony Gianino with a law license in 1998.
The Massachusetts Board of Bar Overseers found John guilty of the following misconduct.
John prepared estate planning documents for a client that included a durable power of attorney and an irrevocable trust. The client’s daughter was named attorney-in-fact and trustee of the trust. Two years after the mother entered a nursing home. Within a year, the mother owed $28,000 in charges to the nursing home. At the tine she had about $22,000 in a bank account in her name and another $35,000 in the daughter’s name as trustee, thereby making her ineligible for Medicaid.
Subsequently, the daughter sought John’s help in obtaining Medicaid coverage for her mother and paid John a flat fee of $4,500. The time spent by John in assisting the daughter did not require him to spend any substantial time.
Within two weeks of preparing the Medicaid application, the mother died, therefore the $4,500 paid to John was unearned and clearly excessive. The daughter contacted John on numerous occasions demanding a refund of unearned fees, which he failed to respond too. He later refunded her a measly $812.50, which the Board found to be basically a joke.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Board of Bar Overseers punished John by gifting him with a complimentary reprimand.
As we speak (ca. October 2012) John practices with Higgins & Gianino, P.A. at 46 Pleasant Street in Weymouth, Massachusetts.
