Attorney Ricardo Bracamonte of Tucson; unethical crook

 
The state of Arizona presented Ricardo A. Bracamonte with a law license in 1991 after he graduated from the University of Arizona Law School.
 
The Arizona State Bar found Ricardo guilty of engaging in the following misconduct.
  1. Failed to consult w/client so client could make informed decisions regarding representation
  2. Failed to act with due diligence (slacker)
  3. Failed to communicate with client
  4. Charged fee that was excessive
  5. Failed to expedite client’s legal matter
  6. Failed to properly supervise non-attorneys in his office
  7. Engaged in the unauthorized practice of law while license suspended
  8. Failed to take necessary steps to protect client’s interest after being discharged
  9. Failed to safeguard client property/funds
  10. Refused to return unearned fee (crook)
  11. Engaged in a pattern of misconduct
  12. Misconduct involved multiple offenses
In the first matter, Ricardo represented a client in a child-custody matter. He did not memorialize the terms and scope of representation in writing, failed to provide an accounting of funds expended, failed to raise issues with the court that the client requested, and failed to safeguard the client’s property. .

In the second matter, Ricardo was hired to represent a client in a personal injury matter on a contingency fee. He failed to memorialize the contingent fee arrangement in writing, failed to file to serve a complaint and summons on the defendants within the time allowed causing the complaint to be dismissed.
 
In the third matter, Ricardo was retained to represent a client in a criminal matter. The written fee agreement stated that the fee would be reduced by $2,500 if the case did not go to trial. Based on Ricardo’s advice, the client rejected a plea offer from the DA; however, shortly before trial, the client changed his mind and accepted the plea offer. When the client demanded a refund in accordance with the fee agreement, Richard refused to so act.
 
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Ricardo by gifting him with a complimentary censure.
 
As we speak (ca. October 2012) Ricardo practices at 197 East Fort Lowell Road in Tucson, Arizona.
