Attorney F. Scott Stuard of Frankfurt, IN; ethical leper-con
The state of Indiana provided F. Scott Stuard with a law license in 1990.
The Indiana Disciplinary Commission found Stuard guilty of the following misconduct.
In one matter, F. Scott represented a client in a personal injury matter. While the lawsuit was ongoing, F. Scott failed to respond to discovery requests he received on behalf of his client from defense counsel. Subsequently, the trial judge warned F. Scott that his continuing failure to respond to discovery would result in a dismissal of his client’s lawsuit with prejudice. With prejudice means the client is forever barred from filing the claim in the future.
Despite the warnings of the trial court, F. Scott never responded to the discovery requests. This led to the trial judge dismissing his client’s case. Several months later, F. Scott told his client about the dismissal and wrote him a check for $15,000 to compensate him for his loss, telling the client he would provide additional compensation if the client could produce evidence of further damages. Of course F. Scott never advised his client (victim of malpractice) to seek independent counsel before accepting the $15,000.
As a consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the Indiana Supreme Court punished Stuard by gifting him with a complimentary 60-day suspension of his law license.
As we speak (ca. October 2012) F. Scott practices with Martin & Stuard at 12 South Main Street in Frankfurt, Indiana.
