Attorney James Daniels of Kansas City, MO; repeater, moron

The Kansas Supreme Court presented James Lee Daniels with a law license in 1993. James is also licensed to practice in Missouri.

In 2007 the Kansas Board for Discipline of Attorneys found James guilty of the following misconduct:
  1. Failed to safeguard client funds
  2. Engaged in conduct involving fraud, dishonest, deceit or misrepresentation
  3. Failed to provide requested information to disciplinary board (Up Yours, said Jimmy!)
  4. Failed to provide competent representation (moron)
  5. Failed to keep client informed about the status of a legal matter
  6. Failed to act with reasonable diligence (slacker)
  7. Repeatedly failed to respond to client phone calls
  8. Failed to return client’s property to her after being fired
  9. Intentionally provided false/fabricated information about pending legal matter
  10. Engaged in a pattern of misconduct
  11. Committed multiple offenses
  12. Engaged in bad faith conduct in obstructing disciplinary process
  13. Provided evasive testimony during disciplinary hearing
In one matter, James was hired by Tina Wakes to file a lawsuit against the city of Topeka when her daughter was struck and killed by an off-duty Topeka police while waling in a crossroad in Topeka.

When Tina hired James there was only four months remaining on the two-year statute of limitations to file the lawsuit. James agreed to file suit against the city alleging that city officials tried to protect the off-duty police officer by not properly administering a valid alcohol concentration test and/or that city officials engaged in a cover-up to protect the officer.

Jimmy subsequently filed the lawsuit in the Federal District Court. The City of Topeka’s lawyers filed a motion to have the lawsuit dismissed because it was filed after the two-year statute of limitations had passed. Jimmy then filed a moronic defense to the motion to dismiss. The judge wasn’t impressed and dismissed the case with prejudice, which lawfully prevented the Tina from ever pursuing the case in the future.

After the court dismissed the case, Jimmy found it acceptable to repeatedly lie to Ms. Wakes that the case was still active. In fact, he advised her in a letter that he had responded to the city’s motion to dismiss and was awaiting a ruling by the trial judge.

Jimmy the Repeat Offender

Jimmy was disciplined six (6) separate times by the Missouri State Bar for engaging in a variety of misconduct. He was sanctioned in 1999, 2000, 2001, 2003, and twice in 2004.

While testifying under oath at the disciplinary hearing, Jimmy was asked if had been the subject of disciplinary proceedings in Missouri since he practiced there. Jimmy testified that he could not “recall off the top of his head.” Jimmy gave this false testimony even though he knew the disciplinary authorities knew he was lying.

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Kansas Supreme Court punished Pete the Loser by gifting him with a complimentary censure.

As we speak (ca. September 2012) James with the Daniels Law Firm at 1125 Grand Blvd. in Kansas City, Missouri.
