Attorney Herb Elesh of Wheeling, IL; repeater, extortionist

 
The state of Illinois presented Herb N. Elesh with a law license in 1996.
 
The Disciplinary Commission found Herb guilty of misconduct on at least two occasions.
 
Herb’s 1st bite at the Attorney Misfit Apple Tree 
  1. Failed to act with reasonable diligence (slacker)
  2. Failed to keep client reasonably informed of status of legal matter
  3. Failed to promptly comply with client requests for information
  4. Failed to explain matter to extent necessary to afford client ability to make informed decisions
  5. Engaged in conduct prejudicial to the administration of justice
  6. Engaged in conduct tending to bring the legal profession into disrepute
As a consequence of her misconduct, the Patron Saints for Attorney Misfits sitting on the Illinois Supreme Court punished Herb by gifting him with a complimentary 90-day suspension of his law license.
 
Herb’s 2nd bite at the Attorney Misfit Apple Tree 

  1. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  2. Threatening to file criminal charges to gain advantage in civil matter
  3. Asserting a position he knew would serve to harass or maliciously injure another
  4. Made a statement of material fact he knew was false
  5. Communicated with person he knew was represented by counsel
  6. Engaged in conduct prejudicial to the administration of justice
Herb represented a client in a lawsuit against a drug rehab facility. While the lawsuit was ongoing, Herb thought it would be acceptable to threaten to file criminal charges against the facility if they did not agree to pay $18,000 to settle the matter, which included $2,500 in attorney fees for Herb within 48 hours after receipt of his extortionist letter.
 
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Illinois Supreme Court punished Herb by gifting him with a complimentary 180-day suspension of his law license.
 
As we speak (ca. September 2012) Herb practices at 401 South Milwaukee Avenue in Wheeling, Illinois, which is about 30 miles northwest of Chicago.
