Attorney Mark Griffin of Portland, OR; ethical leprechaun

The state of Oregon provided Mark E. Griffin with a law license in 1972.

The Oregon State Bar found Mark guilty of the following misconduct.
  1. Engaged in conduct involving fraud, deceit, dishonest or misrepresentation
  2. Failed to provide full and true (lied) responses to ethics investigators
  3. Engaged in a conflict of interest
  4. Entered into settlement agreement restricting lawyer’s future right to practice law
William represented Eric Bramel and his wife, former hand-tool distributors in resolving claims against Mac Tools, which is owned by The Stanley Works. At the time, William also represented 48 other clients who had claims against Stanley.

Subsequently, William and three other lawyers representing 71 other clients with claims against Stanley agreed with Stanley to a proposed settlement of all claims for $13.3 million. The agreement did not mention that William and the other plaintiffs attorneys were to be retained by Stanley in the future.

Subsequently, William met William attended an emergency meeting in Chicago to discuss the settlement and retainer. At that meeting, a mediator proposed that William sign an individual retainer agreement with Stanley and place it in “escrow” with the mediator until all of his clients had signed the settlement agreement. William then signed settlement and escrow agreements.

After the case was completely settled with Stanley, William agreed to switch sides and provide legal advice and counsel to Stanley.

As a consequence of his misconduct, the enablers for Attorney Misfits at the Oregon State Bar punished Mark by gifting him with a complimentary 12-month suspension of his law license
