The State of New York provided Mary Hauser Smith with a law license in 1978 after she graduated from Hofstra University Law School.
 
The New York Judicial Commission found Judge McKeon guilty of the following misconduct while sitting as a Westchester County Court Judge in White Plains, New York.
 
While on the bench, Bruce presided over several ex parte applications in a family offense proceeding involving Nancy and Joseph. Subsequently, Nancy and Joseph were divorced.
 
Mary presided over the murder case of Moses Blasini who was represented by Lawrence Porcari. While Porcari was out of the courtroom, Mary had an illegal ex parte conversation with Blasini in which she attempted to persuade him to plead guilty.
 
When two prosecutors who were present in the courtroom questioned Mary’s conduct in speaking to a defendant when his lawyer wasn’t present, Mary ordered the prosecutors to leave the courtroom. One of the prosecutors again told Mary her discussion with the defendant was improper, but Mary insisted it was proper for her to so act. Mary then continued to suggest to the defendant, in the absence of his attorney, that he plead guilty.
 
In open court, Mary stated that the defendant indicated a desire to plead guilt y and she was concerned that his attorney Porcari wasn’t acting in accordance with his client’s wishes. Mary disregarded Poracri’s request that she not speak directly to his client.
 
There were several others instances wherein Mary engaged in illegal ex parte communications with criminal defendants and/or attorneys involved in the cases.
 
The Commission ruled that Mary engaged in a pattern of inappropriate behavior that compromised the constitutional rights of the parties involved and created the appearance that she was biased, which of course she was.
 
As a consequence of her misconduct, the apologists for Judicial Misfits sitting on the Judicial Commission punished Mary by gifting her with a complimentary censure.
 
As we speak (ca. August 2012) Mary continues to sit as on the Westchester County Court in White Plains.
