Attorney John C. Mitchell II of Winter Park, FL; bully, deadbeat

The state of Florida presented John Charles Mitchell II with a law license in 1980 after he graduated from Campbell University, Norman Wiggins Law School.

The Florida Bar found John guilty of the following misconduct.
  1. Engaging in conduct prejudicial to the administration of justice
  2. Committing an act that is unlawful or contrary to honesty and justice
  3. Bringing a legal action that he knew was frivolous
  4. Threatening to present disciplinary charges solely to obtain an advantage in civil lawsuit
  5. Use of means to embarrass, delay, or burden a third person
  6. Committing a criminal act that reflects on fitness to practice law
  7. Engaging in conduct involving fraud, deceit, dishonesty or misrepresentation
  8. Gave false testimony during hearing
In 2008, Robert and Lynn Halle, owners of Halle Construction sued John and his wife Bonnie regarding a dispute involving renovation and construction to John’s residence in Winter Park.

While the lawsuit was pending, John told Mr. Halle that if he “didn’t walk away” from the lawsuit he would “make his life a living hell.” Shortly thereafter, John filed a sham complaint with the Dept. of Business and Professional Regulation against Mr. Halle, which was summarily dismissed.

Mr. Halle’s attorney hired Jeff Hudson to assist in interviewing witnesses regarding the lawsuit. John contacted Mr. Hudson and falsely accused him of impersonating him, and threatened to file a bar complaint against him if he continued to make further inquiries of the witnesses.

In March 2009, John, pretending to be Larry Smith, who had business dealings with Halle Construction, posted negative comments on the Internet about Halle Construction.

Despite irrefutable evidence that he impersonated another lawyer in his zeal to extort concessions from Mr. Halle, Johnny denied he did so under oath during a haring.

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Florida Supreme Court punished John by gifting him with a complimentary 30-day suspension of his law license.

Because Attorney Misfits in Florida are held to a much lower standard of conduct then everyone else, Johnny was never criminally prosecuted for perjury.

As we speak (ca. August 2012) John practices with John Mitchell PA at 145 Killarney Drive in Winter Park, Florida.
