Attorney E. David Duncan of Albany, NY; moronic loser

 
The state of New York presented E. David Duncan with a law license in 1958 after he graduated from Albany Law School.
 
At the time of his misconduct, Duncan was sitting as a judge on the Albany City Court. During his tenure on the bench, the Judicial Commission found Duncan guilty of the following misconduct.
 
The thrust of Duncan’s misconduct involved his refusal to withdraw from cases where it was obvious that a conflict of interest existed and/or that he was clearly biased.
 
One matter involved a speeding ticket issued taxi-driver to JoAnn Pitman. It also involved 2 speeding tickets issued to Ms. Pittman’s taxi-driver boyfriend Robert Libertucci. When Pitman and Libertucci’s cases were called before Duncan, he was forced to dismiss all charges because he officer issuing the tickets never submitted an affidavit attesting to the truth of the chares.
 
Duncan was especially biased against Libertucci because he received a ticket for speeding in Duncan’s neighborhood. To prove he was biased and vindictive, Duncan ordered the police to reissue the speeding tickets to Pittman and Libertucci.
 
An attorney for Pittman and Libertucci filed a motion to dismiss the newly issued tickets as being contrary to law. In order to get even with the defendants, Duncan refused to rule on the pending motions for almost two-years. New York Law required Duncan to issue a ruling on the pending motions within 60-days. Of course Duncan the Loser doesn’t much care about any “stinkin laws.”
 
It was patently clear that the Dishonorable Duncan decided to teach Mr. Libertucci and his girlfriend a lesson because Libertucci had the audacity to speed in his Dishonor’s neighborhood.
 
As a consequence of his misconduct, the cheerleaders for Judicial Misfits sitting on the Judicial Commission punished Duncan by gifting him with a complimentary admonition.
 
As we speak (ca. July 2012) Duncan practices with the Law Offices of E. David Duncan at 112 State Street in Albany, New York.
