Judge John Stuard of Warren, OH; serial scofflaw, lifetime porker
The state of Ohio provided John Stuard with a law license in 1965 after he graduated from the University of Kentucky.
Since receiving his law license in 1965, Judge Stuard has had his significant snout firmly implanted in the public trough. For the past 44 years (ca. 1968 to 2012), Stuard has been employed by the City of Warren and/or Warren County. Its pretty clear that no self-respecting law firm in the greater Warren, Akron and/or Cleveland area was about to offer this buffoon (my apologies to buffoons) a good paying job.
While Judge Stuard was presiding over the murder trial of Donna Roberts he found it acceptable to engage in ex parte communications with Assistant Trumbull County Prosecutor Becker.
A jury subsequently convicted Roberts of aggravated murder and recommended the death sentence. Sometime between the penalty-phase hearing and the sentencing hearing, Stuart had 4 ex parte communications with Becker. Judge Stuard asked Becker and Becker agreed to prepare a sentencing opinion. Judge Stuard assisted Becker by giving him two pages of his notes weighting the aggravating and mitigating factors in deciding if the death sentence was appropriate. Judge Stuard also instructed Becker to refer to the sentencing opinion in another murder case.
The 2nd illegal ex parte communication took place when Stuard found a 17-page draft of the sentencing opinion on his desk. He then reviewed the draft, noted several corrections to be made, and then made his 3rd ex parte communication by asking Becker to make the corrections he had noted. Becker then made the corrections he received from Judge Stuard.
The 4th illegal ex parte communication took place when Judge Stuard received the corrected version of what became his sentencing opinion.
As a consequence of his misconduct, the supporters of Judicial Misfits sitting on the Ohio Supreme Court punished Judge Stuard by gifting him with a complimentary reprimand.
As we speak (ca. June 2012) Stuard the Loser continues to sit as a Trumbull County Common Pleas judge.
