Appellate Justice Patricia Bigelow of Los Angeles; ethical elf

The state of California presented Patricia Bigelow with a law license in 1980 after she graduated from Stanford University Law School.

The Code of Judicial Ethics requires appellate judges to recuse themselves if they hold more than $1500 or more of stock in a company involved in a case they are assigned too. Patricia was part of a three-judge-panel considering whether to overturn a $603 million fraud and breach-of-contract against Boeing and one of its subsidiaries.

At the time she was assigned herself to the panel, Patricia owned Boeing stock worth $2,000 to $10,000 according to court documents. (LA Times) Of interest is the fact that Patricia replaced Judge Elizabeth Grimes who was forced to resign from the panel because she owned between $101,000 and $1 million in Boeing stock. For more information on Justice Grimes’ conduct in this matter go to the URL listed at the end of this article.

Despite the specific prohibition requiring her to withdraw from hearing the Boeing appeal, Patricia remained on the case just shortly before a ruling was handed down and only due to being outed by the press.

The California Judicial Commission refuses to acknowledge that an ethics complaint is pending against Patricia. There can be no dispute that she absolutely knew at the outset that her withdrawal from the Boeing case was mandatory. By thumbing her significant snout that the rules she should be removed from the bench.

Unfortunately, the Judicial Commission is in the business of protecting Judicial Misfits like Patricia. Even if a complaint is certified, at best she’ll receive a complimentary reprimand. At worst she’ll be elevated to a seat on the California Supreme Court.
