Panel B of the Arkansas Supreme Court Committee on Professional Conduct found Jimmie guilty of the following misconduct in early 2012.
Jimmie filed a breach of employment lawsuit against the Helena Housing Authority and some of its employees on behalf of his client, Calvin Miller. However, Jimmie the Dumbo never served any of the defendants with a copy of the lawsuit. As a result of Jimmie’s gross negligence, the trial court dismissed Mr. Miller’s lawsuit.
After the dismissal, Jimmie refilled the lawsuit against the same defendants. The Housing Authority filed a summary judgment motion because the five-year statute of limitation for filing the suit had passed. Jimmie never filed a response to the motion nor did he appear at a scheduled hearing when it was heard by the trial court. The trial court granted the motion and Mr. Miller’s lawsuit was dismissed “wh prejudice,” which means he is barred from every pursing the claim again.
The Housing Authority then advised the court that it was forced to spend $2,175.69 in legal fees and costs in defending Jimmie’s frivolous re-filing of a time-barred lawsuit.
As a consequence of his misconduct, the Arkansas Supreme Court punished Jimmie by gifting her with a complimentary reprimand.
As we speak (ca. June 2012) Jimmie practices law at 821 Plaza in West Helena, Arkansas.
