Attorney Kenneth P. Andresen of Charlotte, NC; ethical leprechaun

 
The state of North Carolina presented Kenneth P. Andresen with a law license in 1980.
 
The North Carolina State Bar charged Kenneth with the following misconduct in April 2012.
  1. Engaging in a conflict of interest
  2. Failing to advise client to employ another attorney re: conflict of interest
  3. Took an ownership interest in a client’s company
  4. Entered into a prohibited business transaction with a client
  5. Failed to deposit client funds in a trust account
  6. Used client funds for his own personal use
  7. Failed to promptly to client’s request for refund of client’s funds
  8. Failed to promptly respond to reasonable client requests for information
  9. Commingled client funds with his personal funds
In one matter Kenny prepared an operating agreement for NC Barringer Sand which provided that Mr. Johnson and his son would each own 24% of the company. Kenny gave himself a 22.4% ownership in the company, and while doing so never advised Johnson or his son of the inherent conflict of interest.
 
In another matter, Kenny represented W. Markham, Jr. who was accused of embezzling money from his employer. Markham’s restitution to his employer required him to post a $17,000 civil bond. When the matter was settled the Clerk of Court refunded the $17,000 to Kenneth as counsel for Markham. Kenny then applied the $17,000 towards his claim for attorney fees; however, he never obtained any authority from Markham to so act. Markham never recovered any of the $17,000 civil bond from Kenney.
 
All that’s left now is to see what punishment if any that the North Carolina Supreme Court visits upon Kenneth. Given its rather deplorable record, I suspect that at worst Kenny will receive a complimentary reprimand.
