Attorney Phillip Willette of Pickerington, OH; ethical dwarf

 
The state of Ohio presented Phillip Brian Willette with a law license in 1976 after he graduated from University of Baltimore Law School.
 
The Columbus Bar Association Grievance Committee found Phillip guilty of the following misconduct.
 
Phillip entered in a contract with Estate Planning Legal Services (EPLS), a Michigan Law firm to market and sell livings trusts and other estate-planning services in Ohio. The contact provided that EPLS would be Philip’s exclusive agent for marketing, sales, and preparing estate-planning packages. For any client EPLS referred to Philip he would pay them the lesser of $750 or 50% of the client’s fee as a marketing and documentation-preparation fee.
 
Subsequently, EPLS telemarketer Janice Tolbert contacted the Trotts, which led Philip to contact them. The Trotts agreed to have Philip prepare a standard living trust for $1,500 and while doing so he collected personal and financial information from them. However, without their consent or knowledge he forwarded the confidential information to EPLS.
 
In aggravation, the board found Philip guilty of:
  1. Committing multiple violations
  2. Refused to acknowledge the wrongful nature of his conduct
  3. Concealed material information from the Trotts
  4. Only agreed to return a portion of unearned fees to the Trotts in exchange for a full liability release
  5. Did not refund unearned fees to the Trotts until after the grievance proceeded
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Ohio Supreme Court punished Phillip by gifting him with a 6-month suspension of his law license.
 
As we speak (ca. June 2012) Philip continues to practice law at 9095 Cotswold Drive in Pickerington, Ohio which is a suburb of Columbus.
