Attorney James Dettinger of Toledo, OH; deadbeat
The state of Ohio presented James Frederick Dettinger with a law license in 1974 after he graduated from the University of Toledo Law School.
Disciplinary Counsel of the Ohio Supreme Court found James guilty of the following misconduct.
Jimmy violated the rules that prohibit an attorney from borrowing money from a client without fully disclosing to the client the inherent conflict of interest in doing so.
Jimmy borrowed $25,000 from a client, Sidney Zander. Jimmy gave Zander a promissory not for the full amount that provided for interest at 5% per annum and for a lump sum payoff within two years. Jimmy continued to represent Zander in various commercial and personal transactions after receiving the loan and executing the promissory note.
About one year before the note became due, Zander passed away. Jimmy then represented Zander’s son as executor of the Zander estate. Jimmy didn’t advise the son of the conflict he had in representing the estate when he owed the estate $25,000 plus interest.
Jimmy did not pay off the loan until four (4) years after it was due. Additionally, he did not pay the estate the $7,500 in interest it was due on the $25,000 loan.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Ohio Supreme Court punished James by gifting him with a complimentary six-month stayed suspension of her law license. In truth, Jimmy received absolutely no punishment of any kind.
As we speak (ca. May 2012) Jimmy practices law at 405 Madison Avenue in Toledo, Ohio.
