The state of North Carolina presented Tolly Albert Kennon III with a law license in 2001 after he graduated from the University of Miami School of Law.

The Grievance Committee of the North Carolina State Bar found Tolly guilty of engaging in the following misconduct.

  • Engaged in conduct prejudicial to the administration of justice
  • Misconduct involved multiple offenses
  • Told client she could choose to not honor a government subpoena
  • Advised his client she could leave the jurisdiction to avoid complying with government subpoena
  • Acted to unlawfully obstruct another party's access to evidence
  • Gave legal advice to an unrepresented person whose interests were in conflict or had a reasonable possibility of being in conflict with those of his client
  • Engaged in a pattern of misconduct
  • Victims of misconduct were vulnerable

As a direct consequence of his misconduct, Grievance Committee punished Tolly with a complimentary 3-year suspension of his law license.
