Re: Ethics complaint v. Chief Justice Maureen O’Connor

 

Dear Mr. Caligiu:

 

The following ethics complaint deals with the unethical conduct and/or misfeasance in performance of her official duties regarding the assignment of retired Judge Joseph Giulitto pursuant to requests by his daughter Paula which constitute violations of the Nepotism laws in Ohio. (See copies of recent ethics complaints v. Joseph and Paula Giulitto filed with your office and which can be located by visiting the URL’s listed at the end of this complaint.

 

Code of Conduct Violations

 

CANON 1:A judge should participate in establishing, maintaining, and enforcing high standards of conduct.

 

CANON 2:A Judge Shall Respect and Comply with the Law and Shall Act at all Times in a Manner that Promotes Public Confidence in the

Integrity and Impartiality of the Judiciary.

 

CANON 4:A Judge Shall Avoid Impropriety and the Appearance of Impropriety in all of the Judge's Activities.

 

As Chief Justice, O’Connor is the sole authority regarding the assignment of active and/or retired judges to sit on various courts throughout the state. The ethics complaints filed with the Ohio Ethics Commission regarding Judge Paula Giulitto and her father retired Judge Joseph Giulitto specifically spell out Justice O’Connor’s serial violations of the Complicity statute. As such, said ethics complaints v Joseph and Paula Giulitto are incorporated herein as if fully written.

 

The Complicity Statute states as follows:

 

(A) No person, acting with the kind of culpability required for the commission of an offense [nepotism], shall do any of the follow:

(2) Aid or abet another in committing the offense [nepotism]

(F) Whoever violates this section is guilty of complicity in the commission of an offense and shall be prosecuted and punished as if he were a principal offender.

 

Under Ohio Ethics Law, the crime of complicity in relation to nepotism is a fourth-degree felony, which can lead to a prison sentence of 6 to 18 months and a $5,000.00 fine.

 

It would be laughable for CJ O’Connor to proclaim that she was unaware that Joseph was Paula’s father when she personally granted 46 general 3-month assignment requests submitted by Paula as Administrative Judge for Portage County beginning on January 3, 2011 through March 2022.

 

Every one of the 46 assignments personally approved by CJ O’Connor states the following:

  • Requesting Judge: Paula Giulitto
  • Assigned Judge: Joseph Giulitto
  • Court: Portage County Court of Common Pleas, Domestic Relations Division

How many Judges with the last name Giulitto does CJ O’Connor believe sat as a Domestic Relations Administrative Judge in Portage County? Did she think that the last name Giulitto was as common as Smith or Jones? There is no doubt that she was intimately aware that Joseph was Paula’s father.

 

Chief Justice O’Connor was instrumental and complicit in allowing the Giulitto’s to engage in serial criminal violations of Ohio’s Nepotism Law. In fact, she is likely guilty of engaging in a years-long conspiracy to allow such criminal conduct to thrive.

 

Please provide me with a copy of Chief Justice O’Connor’s answer to this complaint.
