Attorney David Winkel of Neenah, WI; thief, repeat offender
The state of Illinois presented David J. Winkel with a law license in 1984 after he graduated from the University of Michigan Law School.
The Wisconsin Office of Lawyer Regulation (OLR) found David guilty of the following misconduct.
Dave’s clients (victims) signed a fee agreement to pay him an hourly rate for representing them on a tax matter. One of Dave’s associate’s subsequently represented the clients on a Social Security disability claim. Shortly after the disability benefits were paid, the associate left Dave’s firm. Dave was required to submit a fee petition to the Social Security Administration that included an itemized hourly statement.
Rather than using the 12.8 hours previously reported by his now departed associate, Dave reconstructed (fabricated) a statement estimating that it would have taken him 30 hours to perform the same tasks. This sham claim even though Dave was much more experienced than his associate.
Because of his fraud on his clients, Dave received $934 in fees he was not lawfully entitled too.
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Wisconsin Supreme Court punished Dave by gifting him with a complimentary reprimand.
As one would suspect, this wasn’t Dave’s 1st bite at the Attorney Misfit Apple Tree. He previously received a complimentary reprimand for similar misconduct.
As we speak (ca. June 2012) David practices law with David J. Winkel Law Offices at 411 South Commercial Street in Neenah, Wisconsin.
