Attorney Elaine Kelley of Linden, NC; convicted thief

 

The state of North Carolina presented Elaine S. Kelley with a law license in 1986 after she graduated from the Campbell University School of Law.

 

The Grievance Committee of the North Carolina State Bar found Elaine guilty of the following misconduct, all of which took place while she was employed as a State of North Carolina assistant District Attorney for the Thirteenth Prosecutorial District.

  • Entered into agreement with another assistant DA Gore that she would be compensated as assistant DA by receiving reimbursement form the North Carolina Administrative Office of mileage she did not incur
  • Elaine and Gore agreed that Elaine would submit to the Administrative Office of the Courts expense reports representing that each week she had driven between the courthouses in Elizabethtown and Bolivia, North Carolina, although she and Gore knew that her duties would not require her to make that drive
  • After entering into the agreement with Gore, Elaine submitted to the Administrative Office of the Courts sixty-three expense reports containing false certifications of mileage
  • Elain signed each certification of mileage below the words "[under penalty of perjury, I certify that this is a true and accurate statement of the lodging, expenses, and allowances incurred in the service of the state"
  • Elaine received reimbursement of $14, 190.39 from the Administrative Office of the Courts for mileage she had not driven
  • Pled guilty to the common law offense of misprision of a felony, a misdemeanor
  • Engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation
  • Engaged in conduct prejudicial to the administration of justice

As a direct consequence of her misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Elaine by gifting her with a complimentary 6-month suspension of her law license.

 

As we speak (ca. September 2020), Elaine practices at 8750 Steeplechase Drive in Linden, North Carolina.
