Attorney Dan M. Walters of Rochester, NY; degenerate liar, ethical gnome

 
The state of New York presented Dan Montgomery Walters with a law license in 1971 after he graduated from Tulado University.
 
In 2011 the New York Appellate Division, 4th Judicial Department found Dan guilty of the following misconduct.
  1. Making false statements of fact to a tribunal
  2. Conduct prejudicial to the administration of justice
  3. Failing to disclose the identity of his client during a judicial proceeding
  4. Communicating with a party that was represented by an attorney w/o the attorney’s knowledge or consent
  5. Engaging in conduct involving fraud, deceit and dishonesty
  6. Engaged in conduct adversely reflecting on his fitness to practice law
  7. Engaged in a glaring conflict of interest
Danny’s misconduct involved the foreclosure on marital property involving his client and ex-spouse. The bank served the foreclosure complaint on the former spouse of Dan’s client and also on his client. Thereafter, Dan contested the foreclosure on behalf of his client’s former spouse. Dan never disclosed this abhorrent conflict of interest to his client.
 
Subsequently, Dan filed an answer to the complaint and two affidavits wherein he falsely stated (perjury) that he represented his client’s former spouse, and further failed to disclose the true identify of his client to the court.
 
As a consequence of his misconduct, the sympathizers for Attorney Misfits sitting on the New York Appellate Division punished Dan by gifting him with a complimentary censure.
 
As we speak (ca. April 2012) Dan practices law at 2000 Winton Road South in Rochester.
