Attorney Lucas Foust of Bozeman, MT; ethical troll

The state of Montana presented Roberta Miller Cross Guns with a law license in 1992 after he graduated from the University of Montana School of Law.

The Office of Disciplinary Counsel of Montana (ODC) found Luke guilty of the following misconduct.

• Mismanaged office trust account
• Failed to comply with required trust account mandates
• Improperly borrowed from his IOLT trust account     
• Failed to promptly deliver funds to which clients were entitled
• Used trust funds that belonged to other clients and his own earned fees from settled cases to cover the money he improperly withdrew from his trust account
• Did not give several clients all the money owed and belonging to them
• Luke’s use of funds belonging to others, including his transfer of approximately $180,000 not belonging to him from his IOLTA trust account to his operating account, constitutes misappropriation [theft] and mishandling of funds
• Commingled client funds with personal funds
• Failed maintain his IOLTA account in accordance with the Trust Account Maintenance and Audit mandates

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Montana Supreme Court punished Luke by gifting him with a complimentary 7-month suspension of his law license.

As one would suspect, Luke fails to mention the misconduct set forth above on his self-serving website at www.dlucasfoustlaw.com. Apparently, Luke decided to conceal this relevant information from prospective clients so that he would not limit his future victim pool.

As we speak (ca. May 2020), Luke practices with the Foust Law Office PLLC at 3390 South 30th Avenue in Bozeman, Montana.
