Judge Pinkey Carr of Cleveland, OH; ethical goblin

 

The state of Ohio presented Mary Carroll Leahy a law license in 1993 after she graduated from the Cleveland-Marshall School of Law.

 

FYI: Pinkey has had her significant snout firmly implanted in the public trough for the past twenty-seven (27) years. Apparently, no self-respecting law firm in the greater Cleveland area was about to offer her a good paying job.

 

In one matter, the Cleveland Municipal Court Administrative and Presiding Judge Michelle Earley issued an order, a news release from the court and a notice posted on the court’s website telling the public that all such court hearings are postponed. The specific order is as follows:

 

“Criminal cases scheduled for hearings between March 16 and April 3 are rescheduled to prevent community spread of the coronavirus and for the safety of the people who appear before the court and our employees. Those cases are hereby ordered rescheduled for hearing exactly three weeks from the originally scheduled date and time.”

 

Despite said order, Judge issued 33 arrest warrants because the defendants abided by the court order to not appear. During an interview with WJW Channel 8, Judge Carr denied the claim that she issued arrest warrants, and explained she was holding court hearings only for those defendants who showed up to court without knowing about the administrative order.

 

Despite her denial, a courtroom video obtained by Cleveland.com shows Judge Carr issuing multiple warrants and placing arrest bonds on several of them.

 

As a direct consequence of her violation of Judge Earley’s order to postpone all hearings, Ohio Supreme Court Chief Justice Maureen O’Connor issued an order stripping Judge Carr of her authority to hear any criminal/traffic cases until the Chief Justice rules on an emergency motion filed by the county’s public defender seeking to temporarily disqualify her from all such cases.

 

Attorney Marcus Sidoti of Friedman and Gilbert made the following joint statement to Cleveland.com:

  • “Judge Carr’s actions put lives in danger and violated the public trust in a time of global crisis.”
  • “We commend Judge Earley’s swift actions in protecting those in the court system, the employees of the Cleveland Municipal Court and their families.”

All that remains now is to see what the parameters are of an order emanating from the Chief Justice to reign in Judge Carr’s serial thumbing of her nose at Judge Earley’s no-hearing order.

 

As we speak (ca. April 2020), Judge Carr continues to set as a Cleveland Municipal Court judge in Cleveland, Ohio.
