Attorney John Holmes Jr. of Sanford, NC; serial convict, repeater

 

The state of North Carolina provided John Montgomery Holmes Jr. with a law license in 2004 after he graduated from Campbell University Law School.

 

FYI: Campbell University School of Law is ranked as the 166th best law school in the country out of 200 ABA (American Bar Association) accredited law schools.

 

The Grievance Committee of the North Carolina State Bar found Johnny guilty of the following misconduct.

 

Johnny’s 1st bite at the Attorney Misfit Apple Tree

  • Made a false and misleading communication by describing contract attorneys as “member attorneys” when in fact they were not member attorneys
  • Falsely stated or implied that the contract attorneys were a part of a partnership or other professional organization
  • Failed to obtain his clients' consent before splitting collected fees with attorneys who were not in the same firm
  • Improperly divided legal fees paid by his clients
  • Failed to appear on behalf of on client’s behalf
  • Failed to act with due diligence (slacker)
  • Failed to keep client reasonably informed about the status of the matter and
  • Failed to promptly comply with reasonable client information requests
  • Johnny’s conduct result in significant actual harm to his client in that the client was unnecessarily worried, frustrated and confused after receiving a notice from the NCDMV that his driver’s license would be suspended
  • Due to Johnny’s conduct, his client was forced to resolve traffic ticket on his own without the assistance of an attorney
  • Johnny’s operation of TTRNC "Traffic Ticket Restitution of North Carolina" after he purchased the law firm J. Leech, PLLC, resulted in significant potential harm to his clients in that the structure of TTRNC did not allow Johnny to properly supervise and maintain the necessary personal control of each representation to ensure his clients' cases were adequately resolved
  • Johnny’s lack of supervision, actual knowledge of the case status, and personal involvement in the representation put the client at risk to have his representation detrimentally impact his or her life in an unexpected and unwanted manner
  • TTRNC did not allow Defendant's clients to know exactly who was representing them and therefore who to contact if and when problems arose

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Johnny by gifting him with a complimentary censure.

 

Johnny’s 2nd bite at the Attorney Misfit Apple Tree

  • Pled guilty to two misdemeanor counts of assault on a government official
  • Pled guilty to one misdemeanor count of attempted assault on emergency department personnel
  • Pled guilty to one misdemeanor count of second-degree trespass, intoxicated and
  • Pled guilty to one misdemeanor count of resisting a public officer
  • While at the City Limits Saloon in Raleigh, Johnny was told he would not be served any additional alcohol due to his level of intoxication, he became disruptive and was asked to leave the bar
  • Outside the City Limits Saloon, a Wake County Sheriff’s Deputy tried to help Holmes find a cab to take him home
  • When Johnny became belligerent, the Deputy attempted to place Holmes in custody
  • While arresting Johnny, he resisted by twice kicking the Deputy in the shin
  • While being transported to the Wake County Detention Center he became combative
  • Johnny’s disruptive behavior continued when he arrived at the detention center
  • Due to his behavior and intoxication, the detention center nurse referred Holmes to Wake Medical Center for evaluation
  • Several law enforcement officers were present while Johnny was evaluated at Wake Med's emergency department, providing security due to his combative and disruptive conduct
  • While in the ER, Johnny urinated on the floor
  • Because of Johnny’s continued combative and disruptive behavior, he was placed in an isolation room and given an injection of Haldol (antipsychotic medication)
  • After receipt of the Haldol injection, Johnny said he need to pee again and when the nurse handed him a urinal, he threw it and it hit an ER nurse, soaking her uniform
  • Engaged in conduct adversely reflecting on his fitness to practice law
  • Johnny’s conduct resulted in negative impact of defendant's actions on the public's perception of the legal profession
  • Johnny’s conduct had a negative impact of the defendant's actions on the administration of justice

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Johnny by gifting him with a complimentary stayed 3-year suspension of his law license.

 

In truth the comedians sitting on the Grievance Committee of the North Carolina State Bar didn’t mete out any meaningful punishment to Johnny.

 

As we speak (ca. February 2020), Johnny practices with the Holmes Law Firm PLLC at 145 N. Steele Street in Sanford, North Carolina.
