Attorney J. Baxter Schilling of Louisville; liar, ethical leprechuan

 
The state of Kentucky presented J. Baxter Schilling with a law license in 1975.
 
In February 2012, the Kentucky Supreme Court found Schilling guilty of misconduct for his conduct that began more than 15 years ago.
 
Previously, Schilling was appointed by U.S. Bankruptcy Judge Wendell Roberts to serve as examiner in the billion-dollar Chapter 11 bankruptcy reorganization that was filed by Big Rivers Electric Corp. during the 1990s.
 
Over a two year period of time, the banruptcy court awarded Schilling more than $530,000 in fees. Subsequently, Schilling requested an additional $3.9 in fees as a percentage of a $63 million settlement with one of Big Rivers creditors. Said request prompted the federal Rural Utilities Service to file a protest.
 
The bankruptcy trustee filed a motion demanding that Schilling repay all of the fees he was paid because of “his improper actions in negotiating secret, side agreements related to his compensation.”
 
The Kentucky Bar Association’s 17-member Board of Governors found Schilling guilty of five counts of misconduct. The Supreme Court then found Schilling guilty of four counts of misconduct, including a charge that he had made false statements to a tribunal.
 
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Kentucky Supreme Court punished Schilling by gifting him with a complimentary reprimand.
 
Because Attorney Misfits in Kentucky are held to a lower standard of conduct then everyone else, Schilling was never criminally charged or prosecuted for making false statements to a tribunal.
 
As we speak (ca. March 2012) Schilling is practicing law at 1513 S. 4th Street in Louisville.
