Attorney James F. Funke, Jr. of N. Vernon, IN; nepotist, Dufus

 

The state of Indiana presented James F. Funke, Jr. with a law license in 1991 after he graduated from Indiana University.
 
While sitting as a superior court judge in Jennings County, the Jennings Northwest Regional Utilities Commission decided on an expansion of services that included installing sewer lines. The expansion generated significant controversy concerning what a number of citizens believed were onerous rates and charges.
 
Judge Funke’s conduct regarding the expansion of sewer lines led the Judicial Commission to file misconduct charges against him, which included the following:
  • Allowing his clerks to use a rubber stamp with his signature to issue restraining order
  • Intervening on behalf of relatives who sought injunctions against the utility to install sewer lines on or near their property
  • Failed to comply with Indiana laws
  • Failed to disqualify himself from cases involving relatives, including his father
  • Extending protective orders without any pending motions to so act
  • Unlawfully usurped the jurisdiction of another court so as to intervene on behalf of relatives
As a consequence of his misconduct the enablers for Judicial Misfits sitting on the Indiana Supreme Court punished Funke by gifting him with a 15 day suspension from the bench.
 
As we speak (March 2012) James practices at 3135 W. Co. Road in North Vernon, Indiana.
