Attorney Phillip Hineman Jr. of Mesa, AZ; moron, serial offender

 

The state of Arizona presented Phillip D. Hineman Jr. with a law license in 1988 after he graduated from Pepperdine University School of Law.

 

The Arizona State Bar found Phil guilty of engaging in the following misconduct. 

 

Phil’s 1st bite at the Attorney Misfit Apple Tree

  • Failed to provide competent representation (moron)
  • Failed to act with due diligence (slacker)
  • Engaged in a pattern of misconduct
  • Failed to communicate with client
  • Failed to take necessary steps to protect client’s interest after being discharged
  • Failed to expedite client litigation
  • Engaged in conduct prejudicial to the administration of justice
  • Failed to promptly and timely respond to a request for an accounting and itemized billing
  • Failed to return the unearned portion of the retainer (cheater)

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Arizona Supreme Court punished Phil by gifting him with a complimentary censure and assessed costs of the disciplinary proceeding in the amount of $1,499.55. 

 

Phil’s 2nd bite at the Attorney Misfit Apple Tree

  • Engaged in a conflict of interest
  • Charged and/or collected a clearly excessive fee (thief)
  • Failed to adequately communicate the basis of the fee to the client
  • Improperly entered into a business transaction with his client to satisfy unpaid legal fees
  • Improperly accepted a quit claim deed to the client’s house to secure payment for delinquent legal fees
  • Failed to satisfy the affirmative obligation to provide notice to the client to consult with independent counsel regarding quit claim deed issue
  • Absent advice from independent counsel, Mr. Hineman then failed to obtain the client’s written consent to proceed with the transaction.

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Arizona Supreme Court punished Phil by gifting him with a complimentary censure and assessed costs of the disciplinary proceeding in the amount of $4,598.83. 

 

Phil’s 3rd bite at the Attorney Misfit Apple Tree

  • Failed to provide competent representation (moron)
  • Engaged in a conflict of interest
  • Victim of misconduct vulnerable
  • Failed to take into account diminished capacity of client
  • Engaged in conduct prejudicial to the administration of justice
  • Failed to withdraw representation when required to do so

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Arizona Supreme Court punished Phil by gifting him with a complimentary censure and assessed costs of the disciplinary proceeding in the amount of $1,200.00. 

 

Phil’s 4th bite at the Attorney Misfit Apple Tree

  • Engaged in conflict of interest by representing a husband and wife in an uncontested divorce and bankruptcy matter
  • Failed to dismiss lawsuit per client instructions
  • Failed to properly communicate with client
  • Charged and/or collected a clearly excessive fee (cheater)

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Arizona Supreme Court punished Phil by gifting him with a complimentary reprimand and assessed costs of the disciplinary proceeding in the amount of $1,201.60.  

 

As we speak (ca. April 2019) Phil practices with the Law Office of Phil Hineman PC at 1910 South Stapley Drive in Mesa, Arizona.
