Attorney Michael Power of Salt Lake City; cheating loser

 

The state of Utah presented Michael R. Power with a law license in 2009 after he graduated from the University of Utah School of Law.

 

The Ethics and Discipline Committee of the Utah Supreme Court found Mikey guilty of the following misconduct.

  • Failed to communicate with clients
  • Failed to decline/terminate representation when required to so act
  • Failed to fully cooperate with ethics investigators (Screw you, said Mikey!)
  • Misconduct involved multiple offenses
  • Victim of misconduct was vulnerable
  • Refused to acknowledge wrongful nature of misconduct
  • Failure to communicate with client resulted in a default being entered against the client in a divorce matter
  • Charged the client the full amount of time involved for the motion to set aside the default entered in the divorce matter that came about because of his negligence
  • Never obtained his client’s express authorization prior to using the funds in the client’s financial accounts to pay his legal fees
  • Did not provide the client with any invoices or otherwise inform the client of the payments prior to effectuating payment from the client’s financial accounts
  • There were at least six instances when Mikey obtained funds from the client’s financial accounts in an amount which resulted in an overpayment to him
  • Failed to deposit client funds into a trust account
  • Failed to deposit the advance expert witness fee into his trust account
  • Never retained expert witness on behalf of client
  • Failed to refund the advance fee at the time his representation was terminated and instead, applied the amount of the advance fee to the client’s final invoice, which was not sent to the client for several months after he was terminated

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Utah Supreme Court punished Mikey by gifting him with a complimentary 18-month suspension of his law license.

 

As we speak (ca. February 2019), Mikey practices with Power LC at 5053 South Scarsdale Court in Salt Lake City, Utah.
