Attorney J. Marcus Whitlark of Columbia, SC; deadbeat, repeat offender

 

The state of South Carolina presented J. Marcus Whitlark with a law license in 1984 after he graduated from the University of South Carolina School of Law.

 

Disciplinary Counsel of the South Carolina Supreme Court found Marcus guilty of the following misconduct.

 

Marcus’ 1st bite at the Attorney Misfit Apple Tree

  • Engaged in conduct prejudicial to the administration of justice
  • Used means having no purpose other than to embarrass, delay or burden a third person and/or used methods of obtaining evidence that violated the legal rights of another person
  • Failed to keep disputed property separate until dispute resolved
  • Failed to advise trial judge in personal injury case that he had offered material trial evidence in the form of a neurologist’s bill and testimony that he later learned was partially false
  • On at least seven occasions, Marcus retained the services of a court reporter re: depositions
  • Transcripts of depositions were ordered by Marcus, delivered to his office, along with invoices for a total of $4,041
  • Court reporter forced to sue Marcus in magistrate’s court and obtained default judgment against Marcus

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the South Carolina Supreme Court punished Marcus by gifting him with a complimentary 6-month suspension of his law license.

 

Marcus’ 2nd bite at the Attorney Misfit Apple Tree

  • Failed to pay required annual $225.00 attorney registration fee (deadbeat)

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the South Carolina Supreme Court punished Marcus by gifting him with a complimentary 1-month suspension of his law license.

 

As we speak (ca. November 2018), Marcus practices with Whitlark & Ballou in Columbia, South Carolina.
