Judge Harry Cantrell Jr. of New Orleans; ethical goblin

 

The state of Louisiana presented Harry E. Cantrell Jr. with a law license in  1981 after he graduated form Southern University School of Law.

 

Of the 12 Orleans Parish Criminal District Court judges, Harry is the court’s sole magistrate. This means that, if you are charged with a state crime in New Orleans, Harry will decide if you are entitled to bail, how much you must pay, and whether you must use a bail bondsman. Put simply, Harry literally decides whether thousands of individuals will go free or not as they await trial. (Ian Millhiser)

 

A ruling by a panel of three federal judges found that Harry:

  • Abused his power to effectively jail many individuals for being poor
  • Required use of a bail bond from a for-profit commercial surety and did not allow arrestees to post cash bail
  • Mandated use of bail bond agency when arrestee wished to pay with cash thereby causing financial hardship to the arrestee because they had to pay a percent of the full bail amount to the bail company
  • Released defendant without bail and then had her incarcerated after he found out she was living in a homeless shelter
  • Repeatedly violated defendants’ constitutional right to due process
  • Engaged in a conflict of interest by demanding bail from commercial sureties because the court collects at least $1 million a year in fees from criminal defendants who purchase bail bonds, which is about 20-25 percent of the court’s Judicial Expense Fund

Apparently, Harry is of the opinion that “due process” is the means by which the grass becomes moist in the a.m.

 

There is no indication that the cheerleaders for Judicial Misfits sitting on the Louisiana Judicial Commission is going to take any action against Harry.

 

As we speak (ca. September 2018), Harry continues to sit as a Orleans Parish Criminal Magistrate Judge in New Orleans.
