Judge Malcom Mackey of Los Angeles; moronic loser

 

The state of California presented Malcom H. Mackey with a law license in 1958 after he graduated from Southwestern University School of Law.

 

It should be noted that Malcolm has had his significant snout firmly implanted in the public trough for the past forty years (1978 thru 2018).Apparently, no self-respecting law firm in the Los Angeles area was about to offer Malcolm a good paying job.

 

In one matter, Malcom presided over a case brought by Patricia Honeycutt for discrimination, retaliation, and wrongful termination suit against her former employer, JPMorgan Chase Bank (“Chase”). Chase successfully compelled arbitration of the claims, and the American Arbitration Association (“AAA”) assigned Candace Cooper to arbitrate the matter.

 

During the pendency of the case, Malcolm denied Ms. Honeycutt’s petition to vacate the arbitration award, which had been wholly in favor of Chase. Honeycutt’s appeal was based on arbitrator Cooper’s abject failure to comply with Judicial Council rules that mandated that she disclosure certain potential conflicts of interest.

 

Subsequently, Ms. Honeycutt appealed Malcom’s asinine ruling to the Eighth District Court of Appeals. In reversing Malcom the Moron’s (M&M) ruling, the Court said in part:

  • “The arbitrator disclosure rules are strict and unforgiving. And for good reason.”
  • “Although dispute resolution provider organizations may be in the business of justice, they are still in business.”
  • “The public deserves and needs to know that the system of private justice that has taken over large portions of California law produces fair and just results from neutral decisionmakers.”

In this instance, Candace Cooper decided to rely on her 5th Amendment Right to Remain Silent when she knowingly failed to disclose to the trial court and Ms. Honey cut that she had accepted two (2) prior appointments to arbitrate for Chase and eight (8) instances of arbitrating for Chase’s legal representatives.

 

Of course Malcom the Moron doesn’t much give a damn about being spanked on reversal by the Court of Appeal because no judge in California has ever been tossed from the bench by the Judicial Commission for being a Moron.

 

As we speak (ca. March 2019), Malcom continues to sit as a Los Angeles County Superior Court judge in Los Angeles, California.
