Attorney Thomas Nicotera of Albany, NY; ethical gremlin

The state of New York presented Thomas Charles Nicotera with a law license in 1984 after he graduated from the Salmon P. Chase Law School

The Third Judicial Department Committee on Professional Standards found Tommy guilty of the following misconduct.

  • Commingled client funds with personal funds
  • Wrote numerous checks to numerous payees who were not clients
  • Violated recordkeeping rules re: maintenance of client funds
  • Unable to substantiate which checks were written against which fees
  • Violated recordkeeping requirements applicable to escrow accounts
  • Neglected client legal matters
  • Failed to cooperate with ethics investigators (Screw you, said Tommy!)
  • Failed to use written retainer agreements in domestic relations matters
  • Failed to periodically bill clients as required

As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Professional Standards Committee punished by gifting him with a complimentary 3-year suspension of his law license.

As we speak (ca. September 2018), Dick practices with Richard E. Clark PLLC at 7887 North La Cholla Blvd in Albany, New York.
