Attorney Edward Weisbein of Huntingdon Valley, PA; ethical troll

 

The state of Pennsylvania presented Edward Benjamin Weisbein with a law license in 2002 after he graduated from Widener University Law School.

 

The Office of Disciplinary Counsel (ODC) has found Eddie guilty of the following misconduct.

 

1st Instance of Eddy’s Misconduct

  • Failed to provide competent representation to his client (moron)
  • Failed to act with due diligence (slacker)
  • Engaged in prohibited conduct by bring proceedings when there was no basis in law and fact for doing so that was not frivolous
  • Failed to make reasonable efforts to expedite client litigation consistent with the client’s interests
  • Knowingly made a false statement of material fact or law to a tribunal
  • Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  • Engaged in conduct prejudicial to the administration of justice
  • Represented the plaintiff in medical malpractice actions against Hahnemann University Hospital and various physicians despite Eddy’s knowledge that he had no reasonable basis to do so other than a conversation with Dr. Sean Lenahan who did not have the necessary expertise under the medical circumstances of the case
  • Eddy filed Certificates of Merit wherein he personally certified that an “appropriate licensed professional” had provided a “written statement” to him that there was a basis to conclude that the care, skill or knowledge provided by the defendant physicians “fell outside acceptable professional standards and that such conduct was a cause in bringing about the harm to his client
  • At the time Eddy commenced litigation, nor at the time he filed the Certificates of Merit, did have any have any written opinions from any expert attesting to the alleged medical malpractice of any of the defendant physicians
  • The false statements contained in Eddy’s Certificates of Merit were either knowingly made by Respondent with knowledge of their falsity or made with reckless ignorance of the truth or falsity thereof
  • The client’s medical malpractice complaint was dismissed with prejudice due to Eddy’s failure to respond to defense counsel’s discovery requests
  • After the dismissal of his client’s medical malpractice case, the trial court ruled that Eddy improperly certified that an appropriate licensed professional had supplied a written statement supporting the medical malpractice claims and imposed sanctions of $15,000 against Eddy and his firm

2nd Instance of Eddy’s Misconduct

 

  • Entered into written agreement to represent a client in a civil rights matter (filed pro se); however, over the next 22 months Eddy failed to make any contact with his client or defense counsel in the pro se filed litigation
  • Repeatedly failed to respond to client written correspondence
  • Failed to abide by client's decisions concerning the objectives of the representation
  • Failed to consult with his client about the means by which they are to proceed
  • Failed to take such action on behalf of his client as is impliedly authorized to carry out the representation
  • Failed to act with due diligence (slacker)
  • Failed to promptly inform his client of any decision or circumstance with respect to which the client’s informed consent is required
  • Failed to reasonably consult with his client about the means by which the client's objectives are to be accomplished
  • Failed to his client reasonably informed about the status of a matter
  • Failed to promptly comply with reasonable client information requests
  • Failed to explain a matter to the extent reasonably necessary to permit the client to make informed decisions regarding the representation
  • Failed to make reasonable efforts to expedite litigation consistent with the interests of his client

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Pennsylvania Supreme Court punished Eddie by gifting him with a complimentary 2-year suspension of his law license.

 

As we speak (ca. March 2020) Eddie practices at 96 Roy Lane in Huntingdon, Pennsylvania.
