Re: State Bar’s ruling authorizing use of false testimony by Florida attorneys
 
Dear Ms. Bondi:
 
I quite confident that you up to date on numerous media reports dealing with complaints regarding the unethical of attorney Jose Baez during the just recently concluded trial of Casey Anthony.
 
Based on Mr. Baez’s trial conduct in regards to the testimony he elicited form Casey’s mother, I was convinced that he knowingly elicited testimony that he absolutely knew or should have knows was false. As a result thereof, I filed an ethics complaint with the Florida State Bar and recently received a dismissal of the complaint, copies of both can be found at the URLs at the end of this letter.
 
In its dismissal letter, the State Bar unbelievably stated in part: A lawyer’s reasonable belief that evidence is false does not preclude its presentation to the Trier of fact”
 
I was absolutely stunned to discover that it is permissible for Florida attorneys to elicit false testimony in order to prevail in a criminal and/or civil matter. I’m confident that you are equally stunned!
 
As Florida’s highest elected law-enforcement officer I cannot imagine that you would support such conduct. In fact, I’m sure as an attorney and member of the Florida State Bar that you are thoroughly embarrassed by such a ruling.
 
Obviously, this unprecedented ruling is in effect an admission that Florida’s Judges are basically in the business of acting as referees over “Liars Contests” conducted by attorneys while presenting evidence in support of their claims in criminal or civil trials.
 
This ruling will obviously negate the necessity of “a search for the truth” since truth-telling isn’t likely to bear any financial fruit for the contestants. The State may as well employ a Bob Barker look-alike for each court and have him announce to all of the attorney-contestants prior to trial “Come on Down.”
 
Unfortunately, once this rather unique and novella legal finding becomes known to other State Bar Associations and/or State Supreme Courts, along with the media, the Florida legal community will likely become the laughing stock of the country.
 
I am quite hopeful, in fact I’m confident that you will take appropriate action to reverse the State Bar’s conduct in promoting “subornation of perjury” among the Florida Bar.
 
In addition to filing an ethics complaint against Mr. Baez, I also have communicated with Judge Perry, Chief Justice Canady and State Sen. Ellyn Bogdanoff regarding this matter. Those communications can be found at the URLs listed at the end of this letter.
