Re: Florida State Bar ruling allowing attorneys to present false testimony
 
Dear Senator Bogdanoff:
 
I’m sure you’re well aware of the recently concluded trial of Casey Anthony and the conduct of her attorney Jose Baez. In mid-July I personally filed an ethics complaint with the Florida Bar, a copy of which can be found at http://tinyurl.com/6e3fobw.
 
That complaint basically dealt with Mr. Baez’s conduct in putting forth the testimony of Casey Anthony’s mother, testimony that any reasonably intelligent person knew would be false. On Aug 12, 2011, the Florida State Bar dismissed my complaint. Unbelievably, the State specifically stated in is dismissal: A lawyer’s reasonable belief that evidence is false does not preclude its presentation to the Trier of fact [jury].”

I’m confident that you are absolutely amazed at this absurd ruling. Additionally, as a licensed attorney and sitting member of the Senate Judiciary Committee that you are thoroughly embarrassed.
 
I have always stood for the proposition that every person is entitled to a vigorous defense conducted by a competent attorney. However, for a State Bar to rule that it is acceptable conduct for Florida attorneys to suborn false/fabricated testimony is truly unprecedented and unconscionable.
 
I’m sure that you are as troubled by this obscene ruling as I am and the thousands of visitors to my website are, some of which are your constituents.
 
As the Florida Bar’s, Trial Lawyers Section Legislator of the Year for 2009 I’m hopeful that you’ll do whatever you can to correct this absurdity, which would of course include introducing legislation if necessary.
