Letter to Judge Belvin Perry re: conduct of Atty. Jose Baez in Anthony trial

 

Below is a verbatim copy of a letter sent to Judge Perry via snail mail on the morning of August 10, 2011.

Re: Conduct of attorney Jose Baez in Casey Anthony trial
 
Dear: Judge Perry:
 
It would be a monumental waste of your valuable time for me to repeat herein the numerous instances of unethical conduct that Mr. Baez so cheerfully engaged in prior to and/or during the recently completed Anthony trial.
 
Obviously, every criminal defendant is entitled to a vigorous defense; however, vigorous and unethical are not synonyms. Mr. Baez’s deplorable opening statement that he would prove and/or provide evidence that Casey’s father sexually molested her is a prime example of an attorney treating his oath with utter contempt.
 
As you know Judge Perry, Mr. Baez never offered one iota of evidence to support his defamatory statement aimed at Casey’s father. The reason he didn’t should be obvious to any fair-minded observer. Assuming that the father did molest Casey, what relevance would that have in raising reasonable doubt as to Casey’s guilt?
 
An Officer of the Court (attorney) is under a sworn duty to assist the court in the fair administration of justice (aka, search for the truth.) In intentionally slandering Casey’s father, Baez cheerfully chose to pervert the fair administration of justice.
 
An even more egregious example of Mr. Baez’s misconduct is his performance in regards to the testimony he elicited from Casey’s mother to rebut the prosecutions expert testimony that someone at the Casey home was researching “chloroform” at least 94 times. Rather than drone on, I’ve filed an ethics complaint with the Florida Bar regarding this matter, which can be found at the URL at the end of this letter. Suffice it to say that I am of the belief that Mr. Baez is guilty of suborning perjury.
 
Clearly, a court is empowered to find an attorney in contempt for engaging in misconduct in the court’s presence. Sadly, Mr. Baez believed that since the Casey trial engendered mass media coverage and public attention, he would use it as a tool for self-promotion. That self-promotion included, but is not limited to suborning false testimony and putting forth false/fabricated statements regarding Casey’s father he knew or should have known were untrue.
 
I would implore this court to find Mr. Baez in contempt for the conduct alluded to herein and/or in the Florida Bar complaint. If the court does nothing, it will be inviting even more of the same from Baez or those of his ilk. I can’t imagine that you will sit idly by and give Mr. Baez the proverbial wink and a nod. Patently, you have the judicial authority to act sua sponte (on your own initiative) in sending a message to the Florida Bar that this type of unconscionable conduct will not be tolerated.
 
Also, Judge Perry, I am hopeful that you will consider placing Casey Anthony on probation for a period of time in regards to her prior conviction on four counts of obstruction of justice.
 
Clearly, Ms. Anthony cannot be retried for the unfortunate and untimely death of her daughter Caylee. However, in my opinion, Casey should be sentenced to a reasonable period of probation. With all due respect, the probation period should be consistent with the maximum allowed by law.
 
If there’s anything I can do to assist you in assuring that Mr. Baez answers to the court for his egregious misconduct and/or that Ms. Anthony faces the probation music so to speak, please feel free to contact me. I am emailing a copy of this letter to Mr. Baez to prevent any claims of ex parte communications.
