Attorney Joseph Maria of White Plains, NY; Dumbo

The state of New York presented Joseph Anthony Maria with a law license in 1975 after he graduated from New York University (NYU) Law School.

In one matter, the Appellate Division, First Department found Andy guilty of engaging in the following misconduct involving his prosecution of a legal malpractice case.

In one matter, Joey the Dunce represented the City of White Plains and several of its police offices in regard to a claim of false arrest. Subsequently, the men were cleared of resisting arrest and obstruction charges; however, they sued the city in federal court, alleging false arrest and malicious prosecution. Shortly after the lawsuit was filed, Joey offered the three plaintiffs $10,000 each to settle the lawsuit. However, the city claimed that Joey made a “crucial mistake” when he failed to state in the settlement agreement that the $10,000 for each man was meant to also cover all costs, including their attorney fees.

The three men accepted the $10,000 settlement, which then led to U.S. Judge Robert Patterson awarding $291,000 in attorney fees to the plaintiffs. The city then appealed the $291,000 award, which they lost. This led to Judge Patterson awarding the plaintiffs’ lawyers an additional $106,000 in fees to cover the costs of defending the city’s appeal.

After these two losses, the city then sued Joey for legal malpractice. A jury trial led to an award of $397,000 against Joey for his ignorant representation of the city.
