Attorney Eric Moser of New York City; ethical dwarf

 

The state of New York presented Eric Todd Moser with a law license in1986 after he graduated from Marquette University Law School.

 

In one matter, while he worked with the K&L Gates law firm, Eric represented Roy Brown, CEO of Brown Publishing in his attempt to take control of the company’s assets by Chapter 11 through another company, Brown Media.

 

Brown Media sued K&L and its partners alleging a breach of fiduciary duty, tortious interference and common law fraud. (Andrew Denney, New York Law Journal)

 

Subsequently, Eastern District Judge Arthur D. Spatt granted K&L's motion to dismiss based on res judicata (matter previously adjudicated) grounds, writing that the suit was a "thinly disguised collateral attack" on the bankruptcy orders.

 

A panel of the U.S. Court of Appeals for the Second Circuit in Manhattan didn’t agree with Judge Spatt’s dismissal order and remanded the matter back to the court for further proceedings.

 

In its reversal, the Court of Appeals said the panel disagreed with Spatt’s view that the plaintiffs should have addressed their claims in the bankruptcy proceedings.

 

All that remains now is to see how long it will take for Eric to agree to settle the matter for less than what a jury would likely award to Mr. Brown.
