Attorney Spiros Gonakis of Euclid, OH; incompetent loser

The state of Ohio presented Spiros Emanuel Gonakis with a law license in 1975 after he graduated from Case Western University Law School in Cleveland.

In one matter, Spiros represented Rolvow Properties, LLC, in a real estate transaction involving Rolvow’s sale of an apartment building to Classic Victor, LLC. Spiros was retained to review the real estate purchase agreement, promissory note, and mortgage. Title to the apartment building transferred to Classic Victor on January 9, 2012, and Spiros’ representation of Rolvow ended.

Shortly thereafter, Classic Victor breached the purchase agreement and defaulted on the promissory note and mortgage that it had executed in Rolvow’s favor to secure financing for the sale.

After the breach, Spiros received a letter from attorney Stephen Thomas representing Rolvow Properties. The letter stated that Rolvow had hired Thomas to prosecute claims that arose from the sale of the apartment building. The letter went on to put Spiros on notice that he would be sued for legal malpractice

“Please refer this letter to the carrier of your professional liability, errors and omissions or comprehensive liability insurance policy, or to your legal adviser if you do not maintain any such coverage.”

Rather than contact his malpractice insurer, Spiros sat on his hands and did nothing. As a direct consequence of his inaction, Spiros let his insurer off the hook because he allowed the time allowed to report a claim to lapse. This incompetence led to Spiros now being “personally” liable for any judgment rendered against him for his incompetent representation.
