Attorney Joseph Delk III of Lenoir, NC; ethical dwarf, repeat offender  

 

The state of North Carolina provided Joseph Clay Delk III with a law license in 1976.

 

The Greivance Committee of the North Carolina State Bar found Joey guilty of the following misconduct.

  • Failed to perform quarterly individual client balances on client ledgers
  • Failed to reconcile client balance for each trust account
  • Failed to maintain accurate general ledgers for trust accounts enabling him to properly reconcile bank statements with his records
  • Engaged in a pattern of misconduct
  • Failed to main accurate client ledges
  • Failed on numerous occasions to record on checks the client account against which the items were drawn
  • Failed to indicate on face of checks made payable to Joey the client account from which the payments came from
  • Failed to maintain copies of the front/back of canceled checks
  • Improperly deposited credit/debit card payments into trust account
  • Allowed credit/debit card processor to deduct its fees from the payments and then deposit the remainder in Joey’s trust account
  • Misconduct involved multiple offenses
  • Credited client accounts with full amounts w/o regard to fees that were deducted by the credit/debit card processors
  • Disbursed court costs and/or his fees for the full amount the client paid without regard to the fees deducted by the credit/debit card processors
  • Failed to maintain in trust accounts his own funds specifically to cover credit/debit card fees
  • Utilized funds held for benefit of one client to pay for credit/debit card fees deducted from payments made by other clients
  • Failed to promptly reimburse trust accounts for credit card fees
  • Failed to ensure that deposits made directly to trust accounts via credit/debit cards listed name of client for whose benefit the funds were deposited into the trust accounts

As one would suspect, this wasn’t Joey’s First bite at the Attorney Misfit Apple Tree. He previously received a complimentary admonition for engaging in a variety of misconduct.

 

As a direct consequence of him misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Joey by gifting him with a complimentary stayed 2-year suspension of his law license.

 

In truth, the comedians sitting on the Grievance Committee of the North Carolina State didn’t mete out any meaningful punishment to Joey.
