The state of Arkansas presented Jack R. Kearney with a law license in 1977 after he graduated from the University of Arkansas Law School.

 

The Committee on Professional Conduct found Jack guilty of the following misconduct.

 

Prior to the following misconduct, Jack received one (1) complimentary caution and one (1) complimentary reprimand for engaging in a variety of misconduct.

  • Trust account reflected negative balances during the time period he should have had the money owed to Med-Tech properly safeguarded in the trust account
  • Commingled client funds with personal funds
  • Failed to separate account maintained in the state where office is situated
  • Failed to notify Med-Tech that he had received settlement funds
  • Failed to act with due diligence (slacker)

  • Failed to undertake the necessary steps to obtain an Order extending the time to file the record on appeal

  • Failed to provide competent representation (idiot)

  • Pursued or defended an action or asserted or controverted an issue therein, when there was no basis in law or fact for doing so that was not frivolous
  • Knowingly made false statement of material fact to a tribunal

  • Failed to act with due diligence (slacker)
  • Failed to keep client informed of status of legal matter
  • Engaged in conduct prejudicial to the administration of justice
